Terms and Conditions

1.     General Terms

1.1. The Terms and Conditions are not negotiable and form the basis for any agreement with Mick’s Air-Conditioning Services (Also referred to as Mick’s AC Services or M.A.S). 

1.2. By requesting this service, you are indicating your acceptance of all Terms and Conditions.

1.2.1. The Terms and Conditions of this agreement may change from time to time without notice. Such changes become binding on the date they are publicly posted. Continued use of our services, following any changes, constitutes your acceptance of the modified Terms and Conditions.

1.2.2. Once posted, the Terms and Conditions supersedes all previously agreed to electronic and written Terms and Conditions. 

1.3. Standard operating hours are 8.00 am – 5.00 pm, Monday to Friday, excluding public holidays. 

1.4. Mick’s AC Services are not responsible for any consequential loss or damage by any breakdown, stoppage or failure of machine or equipment from any cause whatsoever. 

1.5. Mick’s AC Services hold no responsibility for the breakage of old and brittle parts which may occur during services and/or repairs to any units. Any cost to replace damaged parts will be the responsibility of the client. 

1.6. Testing to some parts may not be possible if there is no signal/voltage running to them. Due to this, some parts may need to be replaced before a secondary fault can be found. 

1.7. In the case that parts are no longer available (discontinued), and the system cannot be repaired, a quote to replace will be provided.

1.8. Mick’s AC Services does not take any responsibility for any Third-Party Permissions (e.g. Body Corporates). It is the client’s responsibility to ensure permissions are received prior to repairs or installations being undertaken. 

1.8.1. Prior notification of any third-party installation or repair requirements must be advised at time of booking. 

1.9. The client will supply safe and clear access to the equipment to be serviced/ repaired/installed. 

1.9.1. This includes moving of furniture and personal items under or around the appliance that are at risk of damage

1.10. During services/repairs involving water, there is a risk that some electrical components may get wet/damaged unintentionally. Where possible M.A.S will take necessary precautions to reduce this risk. 

2.     Quoting

2.1. Quotes are valid for 14 days from date of quote, unless otherwise stated. 

2.2. Any variations or changes to the requested quote may incur additional costs and will require an amendment to the initial quote. 

2.3. Any variations to quotes, due to further works being required, will be supplied in writing prior to work occurring.

2.4. Quotes do not cover any cosmetic works that may be required as a result of installation or replacement. E.g. painting, plastering etc.

2.5. Quotes do not include any upgrades to electrical mains or switchboard. If needed, an electrician will be required to complete this. 

2.6. Some parts can become discontinued without warning, particularly on older units. This can occur after quoting. In this case, a revised quote will be provided to replace the unit. 

2.7. Acceptance of any quote MUST be in writing by completing and returning the applicable form; or reply email or text message, if minor works. 

2.8. Verbal Acceptance will not be accepted under any circumstances. 

2.9. Acceptance of quote confirms your agreement to all terms and conditions.

3.     Deposits

3.1. Where an air-conditioning unit, appliance or refrigerated equipment is supplied by Mick’s AC Services, a 50% deposit of the unit price is required prior to the unit being ordered. 

3.2. A 50% deposit is required on all parts/materials totalling more than $400.00. Part/s will not be ordered until deposit is received.

3.3. An invoice will be sent for all deposits required upon written acceptance of the quote.

3.4. The remaining balance is to be invoiced on completion of the job.

3.5. Final payment is required within 3 days from the date of invoice, unless otherwise stated.

4.     Parts Supply Only

4.1. Full payment is required for part only orders prior to parts being ordered.

4.2. Parts must be installed by a qualified person.

4.2.1. Mick’s AC Services takes no responsibility for incorrect diagnosis or incorrect fitting by another person.

4.3. Parts cannot be returned once opened or fitted.

4.4. Parts cannot be returned after 21 days from date of invoice.
4.5. All parts are to be collected from our workshop, via appointment only.

5.     Immediate Repairs/After Hours Call Out 

5.1. If immediate repairs are required without official quotation, the client agrees to pay all associated costs for callouts, labour, materials/sundries.

5.2. The client agrees that there may be additional charges applicable for same day/after hours call out.

5.3. The client agrees that an invoice will be supplied for all applicable charges and agrees to pay the total amount incurred as per the Terms and Conditions.

6.     Payments

6.1. All work will entail a minimum labour charge of one hour.
6.2. Terms of payment are Payment on Invoice, unless otherwise agreed.
6.3. Payment methods are Direct Deposit, Cash, or Cheque only. EFTPOS is not available. Direct deposit details are listed on invoices or upon request.

6.4. Statements will not be issued.
6.5. Receipts will not be issued unless requested.
6.6. Title of the goods does not pass until the account has been paid in full.

6.7. Interest may be charged on overdue accounts. In addition, any collection charges, legal expenses, and commissions incurred in attempting to recover payment shall be payable by the customer. 

7.     Cancellations

7.1. Cancellations must be in writing to admin@micksacservices.com.au or via post.

7.2. In the event of cancellation, one of the following will apply:

7.2.1. Should the part/s be able to be cancelled or returned, restocking, freight, and administration charges may apply. These charges will be passed onto the customer.

7.2.2. Should the part/s have been specially ordered for you, and

cannot be returned, the customer agrees to pay, as liquidated damages, a sum equal to 100% of the total purchase price, including freight.

7.3. Administration charges are $25.00 per cancellation.

7.4. Restocking fees (if not stipulated by the manufacturer) will be 10% or $30.00, which ever is greater.

8.     Delays/Default

8.1. Mick’s AC Services endeavours to carry out and complete the requested works by the advised completion date.

8.2. Mick’s AC Services cannot be held liable for a delay or default due to weather, stock/material delay, staff illness, or any other event beyond our reasonable control.

8.3. In the event of this occurring, Mick’s AC Services will endeavour to provide as much notice as possible, and reschedule as soon as possible, to avoid extended delays.

9.     Warranty

9.1. Mick’s AC Services will warrant any issues as a result of our workmanship, provided that we are afforded the opportunity to inspect and repair the fault.

9.2. Mick’s AC Services will not warrant/cover costs, including travel, incurred by another contractor for identification/repair of fault.

9.3. All parts, components, and product warranties are under individual manufacturer warranty discretion.

9.4. Servicing/component checks may be required for warranty purposes.

9.5. Repairs to a unit do not guarantee there will not be further issues. When there is no warranty due to the age of the unit, only the parts replaced will be subject to manufacturer’s/supplier’s warranty if available.

9.6. Mick’s AC Services cannot be held liable for the incorrect size unit being installed if the customer chooses to go against our recommendations. 

9.6.1. Installing an incorrectly rated air-conditioner may void  manufacturer’s warranty.

10.     Privacy 

10.1. The client agrees that their information will be collected, retained, recorded, used, and disclosed in accordance with the Privacy Act 1988 and the Privacy Principles outlined in the Privacy Amendment Act 2012, to persons and/or legal entities who are a solicitor or any other professional consultant engaged by the contractor, debt collector, credit reporting body and/or any other individual or organisation which maintains credit references and/or default listings.

We are committed to reduce our environmental impact and are continually improving our environmental performance as an integral part of our business strategy and operating methods, with regular review points. We will encourage customers, suppliers, and other stakeholders to do the same.

We endeavour to: Comply with and exceed all relevant regulatory requirements. Continually improve and monitor environmental performance. Continually improve and reduce environmental impacts. Incorporate environmental factors into business decisions. Increase employee awareness and training. Minimise, reuse, and recycle where possible. Policies and procedures will be regularly reviewed regarding environmental requirements. 

To achieve our environmental objectives the MAS Team… 

Follow strict guidelines regarding working with and disposing of refrigerants in accordance to regulatory requirements and all staff hold appropriate licencing and complete regular training. Paper, packaging, and other materials used within the office and workshop are minimised and recycled. All components are broken down and separated according to environmentally safe methods and recycled where possible. Consideration is given when planning routes of travel to minimise fuel consumption and manage time efficiently. Clients are given advice on how to best use their appliances in terms of efficiency and environmental impact.

Summary

Environmental Policies and Procedures are regularly reviewed within our organisation. Mick’s Air-Conditioning Services takes our environmental impact very seriously and will continue to strive, maintain, and improve our processes when conducting business.
